OREGON

ACF along with the Chapman family have been fighting for the release of an
APBT named Woody.
in McMinnville. The case has been political and bizarre with alot of
emotions from both sides.
The prosecutors behavior has been irrational and in one hearing Mr Chapman
the APBT owner called the judge dishonest, then the prosecutor tried to
strong arm Mr Chapman in the hallway of the court house which ended up in a
fight. The Chapmans own two Pit Bulls that were involved in a fence fight
where the neighbors dog managed to stick his head thru the fence. One of the
APBT's has been freed, and we are in the Oregon State Court of Appeals over
the other APBT.

A motion for new trial has been filed in the Oregon State Court of Appeals
because the trial court lost the first day of transcript. Memorandums have
been submitted and the prosecutor responded
making irrational statements calling the American Pit Bull Terrier a
"vicious serial killer Pit Bull"
The neighbors dog was injured in the fence fight but recovered, 4 months
later the prosecutors
claiming the dog is now dead and trying to blame it on the APBT's. However
the neigbhors have moved and can't be located. The city of McMinnville is
acting irrational and the animal control agency
is animal rights driven.  ACF has been assisting in the appeal and this case
will go to the State Supreme Court if needed.


OHIO

It official !!! ACF filed the primary appeal brief in the Toledo v Tellings
case this morning. The brief was 27 pages and included over 221 pages of
case law, over 20 exhibits and 15 studies on genetics and behavior. ACF has
been receiving no support from Ohio dog owners on this case but the Animal
Farm Foundation donated 5000,00 to help in the appeal. This is what we
believe the biggest
constitutional challenge to ever take place with 13 experts testifying and
100's of pages of documentation and we intend on winning the case. As
everyone one knows the decision from the trial court did state the ABPT is
not dangerous if its trained and socialized, and we all know training and
socialization applies to all breed of dogs. The Ohio ORC had declared the
Pit Bull vicious, the ORC also has a definition of "dangerous" which does
not require insurance and special confinment which has been leading to
criminal charges to thousands of APBT owners. According to the decision by
the trial court the APBT does not even meet the requirements to delcare it
dangerous. ACF will file a reply brief and an amicus brief in this case.


COUNCIL BLUFFS IOWA

IABSL and ACF consulted with an attorney last night and ACF instructed the
attorney to draft a fee
retainer because its time to litigate Council Bluffs over their Pit Bull
ordinance. We believe the city manipulated their dog bite data. We also
believe the city is being influenced by the AR agenda.


OTTUMWA

ACF is awaiting a proposal from the city on repealing their Pit Bull ban or
else we will go to trial.


In our country at this time there is alot of strange legislation taking
place involving canines, the APBT
and the agenda behind it is beyond belief, it out of control to the point
that its caused government
coruption and domestic terrorism to dog owners. ACF has been working closely
with the Federal
Government to show them the agenda behind the Pit Bull campaign and they are
taking it seriously.

ACF believes there has been too much fighting at the local and state level
and we see the same fight taking place every year, a state law that
prohibits BSL is challenged and dog owners move in and fight, a city is
proposing BSL and dog owners move in and fight to stop it.

The problem is we are not winning any of these battles, we are only
prolonging the end result which will be like Ontario and Italy. You do not
win in legislation if it keeps coming back and back year after year.

There is no basis for breed specific legislation and its being supported by
HSUS and PETA, there is more than enough proof and these organizations need
to be exposed to the entire United States Government by responsible dog
owners and the dog registries. Until this is done the fighting will continue
on and on and never stop and in the end the BSL will prevail. By targeting
the Pit Bull we notice the animal rights agenda is smart, they know where
there is weakness, they have their people (members) involved in dog
organizations, dog registries and they are the ones that cause all the
disruption, they spread rumors and gossip trying to stop agendas that are
succeeding in stopping BSL. The BSL legislation is not something that the
politician comes up with, its being promoted !!
