Ohio Supreme Court upholds Toledo's vicious dog ordinance
 
 
 

 
COLUMBUS — The Ohio Supreme Court this morning upheld the constitutionality of Toledo's ordinance singling out the pit bull as a vicious dog.

'The evidence presented in the trial court supports the conclusion that pit bulls pose a serious danger to the safety of citizens,' wrote Chief Justice Thomas Moyer. 'The state and the city have a legitimate interest in protecting citizens from the danger posed by this breed of domestic dogs.'

The case stemmed from a lawsuit filed by former Toledo resident Paul Tellings, who was cited for violating the city's ordinance that limits pit bulls to one per household and imposes liability insurance.
