A BILL
TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING
SECTION
38-75-795 SO AS TO PROHIBIT THE DENIAL, CANCELLATION, OR
NONRENEWAL OF HOMEOWNERS INSURANCE BASED SOLELY ON THE
PRESENCE OF ONE OR MORE DOMESTICATED DOGS ON THE HOMEOWNERS'
PREMISES, UNLESS A SPECIFIC DOG ON THE PREMISES HAS A
DOCUMENTED HISTORY OF CAUSING SIGNIFICANT DAMAGE TO REAL OR
PERSONAL PROPERTY OR SERIOUS BODILY INJURY TO A PERSON.
Be it enacted by the General Assembly of the
State of South Carolina:
SECTION 1. Article 9, Chapter 75,
Title 38 of the 1976 Code is amended by
adding:
"Section
38-75-795. Notwithstanding any
other provision of law, no insurer may
deny an application for homeowners
insurance, cancel a policy for
homeowners insurance, or nonrenew a
policy for homeowners insurance solely
on the basis that one or more
domesticated dogs reside on the
homeowners' premises unless a specific
dog residing on the homeowners' premises
has a documented history of causing:
(1) significant damage to
real or personal property; or
(2) serious bodily
injury to a person."
SECTION 2.
This act takes
effect upon approval
by the Governor.
