Failure to Perform

 "Be aware:  Any money you have paid in toward the purchase of your puppy is transferable, not refundable.  If you fail to perform (for any reason).  Example:   You decide you are unable to purchase due to financial problems.  If we fail to perform your deposit is refundable or transferable as you prefer.  Examples: The litter is not born  or the puppy you have paid for is not able to be shipped due to injury."
